Baste Duterte formally assumes acting Davao City Mayor role, DILG confirms

The Department of the Interior and Local Government (DILG), through Secretary Jonvic Remulla, has formally directed Davao City Vice Mayor Sebastian “Baste” Duterte to assume the role of Acting Mayor. This directive follows the temporary legal incapacity of former President Rodrigo Roa Duterte (FPRRD), who was proclaimed mayor-elect in absentia.

The DILG’s order, dated June 30, is based on Section 46(a) of the Local Government Code. This provision stipulates that in instances of temporary incapacity, whether due to physical or legal reasons, the Vice Mayor automatically assumes the duties and powers of the Mayor. Secretary Remulla’s letter to Vice Mayor Duterte stated, “You are hereby enjoined to perform the duties and functions of Mayor of Davao City to prevent paralysis of government operations.”

The Commission on Elections (COMELEC) had previously confirmed FPRRD’s proclamation as Mayor of Davao City despite his absence, citing existing legal issues that prevent his assumption of office. The DILG’s action aims to ensure uninterrupted service delivery and local governance in Davao City.

In line with the same succession framework, the DILG has also designated 1st Ranked Sangguniang Panlungsod Member Rodrigo Duterte II as Acting Vice Mayor. This is in accordance with Administrative Order No. 15, series of 2018, which outlines rules for temporarily filling vacancies in local elective offices.

The DILG emphasized that these actions are both legal and necessary to maintain continuity of leadership in Davao City amidst the ongoing legal proceedings involving the former President before the International Criminal Court (ICC).
