Jinggoy: 19 to 20 senators to abide by SC ruling on Sara Duterte impeachment

MANILA, Philippines — Senate President Pro Tempore Jinggoy Estrada stated that an estimated 19 to 20 senators are in favor of abiding by the Supreme Court’s recent decision regarding the impeachment case against Vice President Sara Duterte. The Supreme Court’s ruling declared the impeachment complaint unconstitutional, citing that it violated the one-year ban on filing such a complaint.

Estrada based his assessment on a recent all-senator caucus, where the unanimous decision of the SC was the primary topic of discussion. “Most of the sentiments of my fellow senators are to abide by the ruling of the Supreme Court,” he said. When pressed for a specific number of senators who wished to dismiss the case immediately, he replied, “around 19 to 20.”

Senate’s jurisdiction and potential constitutional crisis

Estrada himself believes the Senate no longer has jurisdiction over the case since the House of Representatives’ filing was deemed unconstitutional by the high tribunal. He stated that the Senate would not convene as an impeachment court.

The Senate is scheduled to vote on August 6 on whether to abide by the SC’s ruling. Estrada emphasized that this vote should proceed regardless of whether a motion for reconsideration is filed with the Supreme Court. He also warned of a potential “constitutional crisis” and “chaos in our government” if the Senate were to defy the SC’s decision.

Counter-resolution and House appeal

A resolution is currently being circulated in the Senate that seeks to appeal the Supreme Court’s decision. According to Senator Francis “Kiko” Pangilinan, the draft resolution has already been signed by him, Senate Minority Leader Vicente “Tito” Sotto III, and Senators Risa Hontiveros and Bam Aquino.

The House of Representatives has until August 11 to file its own motion for reconsideration with the Supreme Court.
